Kroger is using the Supreme Court's Cox ruling to try to end Sony Music's suit over songs in influencer ads
Kroger and 17 affiliates asked a federal court on November 2 to dismiss Sony Music's August suit alleging at least 392 unauthorized uses of its recordings in brand and influencer social posts. Among six grounds, Kroger argues the Supreme Court's March Cox v. Sony decision, which erased a $1 billion verdict against an internet provider, bars liability for paid influencers' posts. A hearing is set for January 14, 2027.
